General

The wording in these regulations and on the entire website applies equally to both sexes, and the use of masculine or feminine language is for convenience only. These rules regulate the relationship between the Website and the Customers on the Website, whether they are an individual, company, corporation, or any other body (below “the Customer”).

By using the Website and its various sections, the Customer declares that they accept the Website’s regulations, including the preface and the suffix above, and completely agree with them. If the Customer does not agree to all or part of the terms of use, they are not allowed to make any use of the Website.

The contents of the Website are intended to provide general information only and do not in any way constitute any professional advice.

The Website www.cincotrend.co.il/ (below – “the Website”) is a website on the internet, which operates a virtual store, and offers its customers information and sales of various products (women’s bags, shoes, purses, etc.) designed by the Company itself (below “the Products”). The Website is owned by Alda Management and Training Ltd. (below “the Company”).

Each person purchasing products and/or intending to purchase and/or receive information through the Website and/or anyone who browses the Website declares and undertakes that they have read the regulations and agree to their instructions.

Terms of use of the Website – purchase of products and receipt of information
Anyone over the age of 18 or a registered corporation may purchase on the Website.

The actions performed on the Website will be solely for the purpose of receiving information and/or ordering products. Use the Website for any other purpose is prohibited.

The purchaser’s order for products will be accepted provided that all of the following conditions are met: (1) approval is given for the transaction by the purchaser’s credit company and/or the payment is arranged in another way to the Company’s satisfaction; (2) the requested products are in stock; (3) The purchaser has a personal e-mail box on the internet, unless the transaction is made by telephone.

Prices, products, and ordering
Before placing the order on the “CINCOTREND” website, the Customer will be asked to enter their full name, e-mail address, telephone number, and address. At the time of ordering, the Customer will be asked to provide the credit card details with which they will make the purchase and the ID card number of the credit cardholder. Credit card details and the ID number are not stored in the Website’s database.

The “CINCOTREND” website presents collections in which various products are photographed, and also enlarged images of each item. The photos are for illustration only. Next to each item, its price is displayed in NIS. A user of the Website can add it to the shopping cart after checking its colors, size, and price. It is possible to change quantities, add items to and remove items from the shopping cart at any time; at the end of the order, the order must be confirmed at the checkout.

In the event that an order is placed for the product displayed on the Website and it turns out that the product is out of stock, the Company undertakes to notify the Customer via e-mail or by phone (at the Company’s choice) of the shortage of the item and reserves the right to offer an alternative color, size or alternative product. If the Customer confirms the order by e-mail or telephone, the order will be placed. If not, the order will be canceled, and the credit card details will be deleted. If the Customer is interested in waiting for the product to return to stock, their order will wait until the item returns to stock, and they will receive appropriate notification.

Delivery will be made up to 5 working days from the moment the order is confirmed. If a special order has been placed, the delivery date will be determined separately with the Company.

At the same time, the Customer is aware that they will not be able to make any claim against the Company if there is a delay in receiving the product beyond the days as mentioned above if these occurred for reasons beyond the Company’s control and including the failure of the shipping company chosen by the Company to provide delivery services at the time of the order.

Details of the purchaser of the Products and the security of the Website
When placing an order to purchase products through the Website, the purchaser will be required to enter personal details, order details, credit card details, etc., in the system (below – the details).

The owners of the Website and/or those who operate it and/or any of its managers and/or those on their behalf are not responsible for the mistake made by the purchaser when entering the details. Also, the above will not be directly or indirectly responsible for any case in which the purchase details are not received in the system and/or for any technical and/or other problem that prevents operations on the Website.

Typing false details is a criminal offense. Legal action will be taken against submitters of false details, including tort claims for damages that may be caused to the Website and/or the Website owners and/or to any of its operators and/or to any of its managers and/or to those on their behalf. In the event of the incorrect entering of details (including the purchaser’s personal details), the Company and/or anyone on its behalf reserves the right to reject the offer.

The details of the operation on the Website, including the details of the offer and the details of the purchaser, but except for the credit card details, will be transmitted using an encrypted security protocol (SSL), commonly used in e-commerce, to the server on which the Website is operated.

These details will not be passed on by the Company and the Website operators to external parties, except as necessary in order to complete the purchase operations performed by the purchaser.

In payments made via the internet, the purchaser will provide the credit card details directly to the clearing company without them passing through the Company at any stage of the purchase.

In telephone purchases, the purchaser will provide the credit card information to the Company representative, and the representative will enter it directly into the clearing company’s servers without keeping the details in the Company’s hands.

The Company reserves the right to use the information provided by the purchaser (excluding credit card information) for the purpose of analysing statistical information. In any such case, the data will not be personally attributed to the perpetrator, and they will not be identifiable in any way.

The store may send e-mail messages to the person performing the operations and contact them in writing or orally with any information regarding the Company’s promotions, innovations on the Website, advertisements from selected commercial entities, etc., unless the purchaser notifies in writing that he is not interested in receiving such messages.

Payment for the Products
Payment is made by credit card, and billing is in NIS. All prices on the Website include VAT. The total amount charged will appear in the shopping cart after the order is confirmed and will include all the items ordered, and the shipping fees corresponding to the order will be specified. The credit card details will be transmitted via a secure server belonging to the clearing company in an encrypted state; if the user still chooses not to provide the credit card details, the order details can be entered for the purpose of making contact via telephone, in order to transfer the credit card details.

Approval of the order and execution is conditional on receiving approval for the transaction from the credit company through the clearing company.

If no approval is given for the transaction, the Company will inform the Customer, and it is the customer’s responsibility to contact the credit company or the bank in order to take care of the appropriate credit line.

If the Customer has not arranged the credit line, the Company may cancel the transaction.

Shipping and product delivery policy
The shipments will be made to areas worldwide, as defined in the shipping regulations (except for a few localities, which we will not be able to reach, in which case the product delivery coordination will be made by phone).

Shipping prices are defined in the shipping regulations.

If the Customer chooses the option of self-collection of the item from the Company’s warehouses, the Customer will not be charged a shipping fee. It is not possible to select the self-collection option if the order has been placed and the item has already been shipped.

If the Customer is interested in collecting the item from the Company’s warehouses, it is their responsibility to coordinate the collection of the Products with the Company.

If a delivery option is selected, the delivery will be made to the address provided during the registration process unless otherwise stated.

If the address provided is to a business, the name of the business must be stated in the order.

The delivery of the products will be made through a shipping company as determined periodically and will be in accordance with the delivery terms customary with that company.

If delivery is delayed or not possible for any reason (security situation, weather, etc.), the Company will find an alternative solution acceptable to both parties.

The Company will make the final decision regarding the cancellation of each shipment.

The Company reserves the right to update the shipping prices periodically, as necessary.

Product return and cancellation of orders
An order made on the Website can be canceled (except for special orders as detailed below) as long as the Products have not been sent by the Company or anyone on its behalf to the address provided.

The notice of cancellation of the order will be made by telephone.

A product that arrived at the Customer’s home and was not used and is complete in its original packaging can be returned to the Company within 14 days by delivery to the Company (delivery will be paid for and performed by the Customer). The responsibility for returning the product in its entirety and a proper manner applies to the ordering customer.

The shipping cost for returning the product is NIS 39 and will be deducted from the credit due to the Customer for returning the product.

The credit card charged in the transaction will be credited with the price of the returned product, less the said shipping cost.

The shipping fee paid will not be credited.

If an order has been placed for a special product, in which the Customer requested that special changes be made to the product, for them only, or an order for a product that is not currently in stock, it will not be possible to return this product, in accordance with the Consumer Protection Act.

Ownership and protection of rights
The CINCOTREND website contains various materials protected by copyright, trademarks, other proprietary rights, including content, images, graphics, music, video, and sound, some of which are owned by the Company and some of which are owned by third parties.

A purchaser and/or customer and/or any third party who performs operations on the Website is not allowed to change, publish, broadcast, or transfer, take part in the transfer or sale and use the Website or part thereof to create a derivative work or exploit the Website, and/or the content of the Website, in whole or in part, for any purpose, other than the purpose for which the Website was created. The Company allows the user to “download” data to their personal computer for personal non-commercial use only, this permit as well as any other legal action on the Website, do not give the user any proprietary right to the said information in particular, and the Website and content of the Website in general.

The user undertakes not to upload to the Website any information of any kind and type, which infringes the copyright, trademarks, and/or any other proprietary right and/or pornographic material and/or material that may constitute defamation, etc. Should the user upload information and/or material as stated above, they undertake to indemnify the Company and/or anyone on its behalf and/or the operators of the Website for any damage and/or expense (including attorney’s fees and legal expenses), which will be caused to them as a result of the user’s inappropriate conduct, as mentioned above.

The Website contains “links” to other sites on the internet. The Company provides these links for convenience only and is not responsible for the information appearing therein or other sites linked to them, their validity, and legality. A purchaser who wishes to use these links does so at their own risk.

The Company will be allowed to close the Website, cancel services or reduce them. Also, the Company is entitled to change the Website policies periodically.

Any dispute that arises between a purchaser and/or customer on the Website and the Company regarding the purchase or any other activity on the Website will be arbitrated in Israel in the courts in Tel Aviv only.

Limitation of Liability
The Company strives to ensure that all its products are in good condition and of the highest quality. However, there may be cases where there is a defect in some of these products.

In such a case, the purchaser is entitled to contact the Company and alert it regarding this matter. The Company will investigate the complaint and may replace the defective product with the same product or credit the purchaser with the total consideration paid for that product at the Company’s sole discretion.

The exclusive responsibility for all products and any information or presentation made on the Website regarding the nature of the Products, including the names of the manufacturers, the quality of the Products, product features, product images, etc., applies to the manufacturers and/or importers and/or authorized resellers of the Products, according to consumer protection laws and regulations.

The Company will not be liable for any damage that may be caused as a result of improper or incorrect use of the Products.

The images on the Website are for illustration purposes only. It should be emphasized that there may be differences in colors or other changes between the appearance of the product in the picture and the product in reality.

The Company is not responsible for products whose installation depends on the purchaser and which have been damaged as a result of incorrect installation.

In any case, the store’s liability, under any legal grounds, for products mentioned in this section will not exceed the amount of the consideration actually paid for the product/service ordered by the purchaser.

The store and/or the owners of the Website and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf are not responsible for the server through which the Website operates being free of viruses or other foreign components or elements that may damage or harm the purchaser’s personal computer or other equipment belonging to the purchaser when they enter and/or order products and/or services and/or use the Website.

Also, the store will not be liable for any illegal activity on the Website carried out by any purchaser or any third party that is not under the Company’s control. The Company shall be entitled to terminate or prevent the engagement or access of purchasers to any part of the Website or the entire website at any stage.

Indemnification and compensation for improper use of the Website
Anyone who improperly uses the Website undertakes to indemnify and compensate the store and/or the owners of the Website and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf for any claim and/or expense and/or damages of any kind and type, including legal expenses, which will be incurred by the Company and/or the owners of the Website and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf.
